Terms of Service

1. Definitions

“Client” refers to any individual or business purchasing services from Fit by David. “Services” refer to personal training, coaching, nutrition planning, wellness support, and related services. “Provider” refers to Fit by David, located in Amsterdam, The Netherlands.

2. Services Offered

Fit by David provides:

- Personal training (1-on-1, duo, or group).

- 12-week programs (minimum 1 session per week).

- Nutrition and lifestyle coaching.

- Wellness and recovery support through partner facilities.

3. Payment

All payments must be made in advance via Shopify or another approved platform. Services will not commence until payment is received in full. Prices include VAT unless otherwise specified.

4. Client Responsibilities

Clients must ensure they are medically fit to participate in exercise and should consult a physician if unsure. Clients must disclose any relevant medical conditions prior to commencing training. The Provider is not liable for injuries resulting from non-disclosure of medical conditions.

5. Liability

Training involves physical exertion and carries inherent risks. Fit by David and associated trainers are not liable for injuries, accidents, or health complications unless caused by proven gross negligence. Clients are strongly advised to maintain personal health and injury insurance.

6. Session Use & Expiry

Training sessions must be used within the agreed contract period (e.g., 12 weeks). Unused sessions will expire at the end of the agreed period and are not transferable or refundable.

7. Corporate Clients

For companies purchasing services for employees, a separate written agreement may apply. In case of conflict, the corporate contract prevails.

8. Confidentiality & Privacy

All client data is handled in accordance with GDPR (EU General Data Protection Regulation). Data shared on Everfit or other apps is used solely for the purpose of delivering services.

9. Governing Law & Jurisdiction

These Terms of Service are governed by Dutch law. Any disputes shall be submitted exclusively to the competent court in Amsterdam, The Netherlands.

10. Amendments

Fit by David reserves the right to amend these Terms and Policies at any time. Updated terms will be published on the website and apply immediately to new purchases.
